In October 2020, the Swedish Post and Telecommunications Authority (PTS) banned the use of businesses participating in 5G spectrum auctions due to so-called “national security” concernsHuawei5G telecom network equipment provided by two Chinese companies, ZTE and ZTE. After Huawei filed a lawsuit over the decision, a Swedish court at one point requested a stay of the ban, but then upheld the ban. After the Stockholm District Administrative Court rejected Huawei-related lawsuits in June last year, Huawei continued to sue PTS in January this year on the grounds that the Swedish government “violated administrative law and violated EU law and the principle of free circulation of goods and services in the EU internal market”. “It is a reasonable consideration that the use of Huawei in the core functions of the 5G network could harm Sweden’s national security,” the Stockholm Administrative Appeals Court said in its ruling. The court held that the ban on Huawei did not violate Swedish or international law. According to the latest ruling, installed Huawei 5G equipment in Sweden needs to be removed by January 1, 2025.
Sweden is the second country in Europe after the UK and the first in the EU to publicly ban Huawei products from being used in its 5G network infrastructure. Some media analysts said that on the one hand, this ruling undermined Huawei’s hope of re-distribution in Europe, and the loss of Huawei’s commercial interests in the Swedish 5G market is expected to reach about 5 billion Swedish kronor. On the other hand, the ruling may have an impact on the economic and trade relations between the two sides. Swedish telecommunications company Ericsson previously said the court’s ruling “will adversely affect Swedish businesses, including Ericsson, and the Swedish economy”.
In January last year, Swedish media exposed that the United States pressured Sweden to ban Huawei from participating in 5G construction. At that time, a spokesperson for the Chinese Ministry of Foreign Affairs said that the achievements and leading advantages of relevant Chinese companies in the 5G field are obvious to all.
